DECLARATION OF JESSICA E. YATES
I, Jessica E. Yates, being over the age of 18 and having personal knowledge of the matters set forth below, about which I am competent to testify, hereby declare as follows:
1. I am Attorney Regulation Counsel, a named defendant in this case and head Colorado’s Office of Attorney Regulation (“OARC”).
2. Plaintiff Youras Ziankovich asserted that he effected service on Attorney Regulation Counsel Yates through the Office of Attorney Regulation Counsel by serving “Hannah Sims, Receptionist” at “2 E. 14th Ave[.], Denver, CO 80302,” at 3:05 p.m. on 12/29/2025. See ECF No. 26-2; see also ECF No. 26, at 2 ¶ 12.
3. Ms. Sims is not employed by OARC.
4. Ms. Sims is not authorized by OARC to accept service on its behalf.
5. OARC is not physically located at that address.
6. For reasons related to confidentiality rules applicable to OARC’s work, OARC has not granted blanket authority to any other person or agency, including the Colorado Department of Law, to accept service on behalf of OARC.
7. Instead, OARC grants such authority only on a case-by-case basis, and only when requested to do so by a plaintiff.
8. Plaintiff Ziankovich has not requested that specific authority here, and he has not been granted that specific authority to serve any non-OARC party.
